Appellant James Coones appeals from a summary judgment which was entered in favor of Appellee Federal Deposit Insurance Corporation (the FDIC) as the receiver for the Stockmens Bank and Trust Company. The district court determined that Coones could not collect damages from the FDIC for its failure to provide a reasonable notice of the sale of repossessed cattle and that moneys expended by Coones while he was acting as a debtor-in-possession during the bankruptcy proceedings in order to preserve and enhance the FDICs collateral were not recoverable.
